"CRIMES OF MORAL TURPITUDE" UNDER THE IMMIGRATION AND NATIONALITY ACT |
| This table -- the most comprehensive list known -- was compiled by Amy Righter from the lists in D. Kesselbrenner & L. Rosenberg, Immigration Law & Crimes, Sample Determinations on the Issue of Moral Turpitude, Appendix E (1997), the Table and Annotations of Crimes Involving Moral Turpitude under the California Penal Code, contained in K. Brady, N. Tooby, et al., California Criminal Law and Immigration (1997), and Annot., What Constitutes "Crime Involving Moral Turpitude" Within Meaning of § 212(a)(9) of Immigration and Nationality Act . . . for Exclusion or Deportation of Aliens Convicted of Such Crime, 23 A.L.R.Fed. 480. To the cases from these sources we added very recent decisions on the question. All holdings that a conviction was not a CMT were included. Some duplicative older decisions concerning common crimes were omitted. Please let us know of any decisions you feel should be added to this Sourcelist, which will be updated from time to time.
